Dispute Support for Loan Agreements

Loan agreements are quite common both in relationships between individuals and in those involving legal entities. Providing monetary funds from one party to another is an integral part of our lives, as each of us has either borrowed or lent money at some point. Some may even have had the unfortunate experience of entering into a loan agreement.

Entering into a loan agreement seems straightforward: transferring money and writing a receipt, or sometimes just handing over the money without bothering with any "unnecessary paperwork." However, it is precisely this "simplicity" of loan agreements that often hides their pitfalls and negative consequences.

At the stage of money transfer, parties often do not think about repayment, and this applies to both borrowers and lenders. When the time comes to "pay the bills," parties realize that the situation is not as simple as it seemed. It is crucial to seek legal help at this point (preferably before the money transfer and formalizing the relationship). This is when the situation can still be resolved with minimal expenses.

"Usconsult" provides qualified legal assistance to both borrowers and lenders, with extensive experience in loan agreement-related matters.

Our Experience:

1.      Defending the Client's Interests in a Lawsuit for Termination of a Loan Agreement and Debt Recovery: The loan agreement was signed on behalf of the client's company by the borrower, but no funds were transferred. The opponents tried to prove the loan by presenting correspondence and alleged debt recognition and repayment payments. Usconsult specialists evaluated the burden of proof in various scenarios and managed to place the responsibility for providing documents on the opponent, who failed to do so. We proved the absence of a loan and secured a full rejection of the claim.

2.      Defending the Client's Interests in a Lawsuit by a Former Partner for Debt Recovery: Usconsult analyzed and evaluated the situation and documents, gathered evidence of repayment and the absence of debt, and submitted requests to various authorities. We proved the existence of a joint business and that the receipts were not ordinary loans but investments in the joint business, with some receipts being contested based on expired statutes of limitations. We significantly reduced the claim amount by more than 90%.

3.      Defending the Client Company's Interests in a Dispute with a Former General Director: The loan agreement was signed by the former general director, who later sued for debt recovery. Usconsult proved the loan's non-existence, showing that the former director signed the agreement himself, the amount was not reflected in the company's accounting records, and the funds were not received. We achieved a full rejection of the claim.

4.      Defending the Lender in a Bankruptcy Proceeding to Include Claims in the Creditors' Registry: The bankruptcy trustee argued the loan interest rate was unfair and economically unjustified. Usconsult proved that the loan interest rate was in line with market conditions and that the lender acted in good faith. The court rejected the trustee's claims and included the full loan amount in the creditors' registry.
